AGREEMENT TO TERMS

These Terms of Service ("Terms", "Terms of Service") govern your use of our emergency guidance application and related services (the "Service") operated by Aidhub Ltd ("us", "we", or "our").

Our Service is accessed via mobile application and web platform, which provides voice-guided emergency first aid instructions processed through ElevenLabs voice technology.

By downloading or using our app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. Please read these Terms of Service carefully before using our Service.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using our Service you agree to be bound by these Terms. If you disagree with any part of these terms then you may not access the Service.

DESCRIPTION OF SERVICE

Aidhub Ltd operates an emergency guidance application that provides:

- Voice-guided first aid instructions based on globally recognized medical protocols

- Real-time emergency response guidance for parents and caregivers processed through ElevenLabs voice technology

- Pediatric-specific emergency protocols and age-appropriate instructions

- Educational content related to emergency preparedness and first aid

SERVICE TIERS:

- Free Tier: Access to emergency guidance for up to 3 sessions

- Full Access: Unlimited emergency guidance sessions unlocked with a one-time payment

Our Service provides general first aid guidance and educational information only. It is NOT a substitute for professional medical advice, diagnosis, or treatment. In any emergency situation, you should always call your local emergency services (112 in Bulgaria/EU) immediately.

ELIGIBILITY

You must be at least 18 years old to use this Service. By using this Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

USER ACCOUNTS

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

PAYMENT TERMS

One-Time Payment Model:

- Free users receive access to 3 emergency guidance sessions

- Full access to unlimited sessions requires a one-time payment processed through Paddle

- Payment unlocks permanent access to all emergency guidance features

No Refunds Policy:

All payments are final and non-refundable. Due to the digital nature of our service and the immediate access provided upon payment, we do not offer refunds under any circumstances.

Payment Processing:

Payments are processed by Paddle, our third-party payment processor. Your payment information is handled according to Paddle's terms of service and privacy policy. We do not store your payment card details.

ACCEPTABLE USE

You may use Service only for lawful purposes and in accordance with Terms. You agree not to use Service:

- In any way that violates any applicable national or international law or regulation

- To provide false or misleading emergency information

- To interfere with or disrupt the Service or servers or networks connected to Service

- To attempt to gain unauthorized access to any portion of the Service

- To exceed your allocated session limits on the free tier

EMERGENCY USE AND MEDICAL DISCLAIMER

CRITICAL SAFETY INFORMATION:

  1. Emergency Services First: In any life-threatening emergency, call 112 (or your local emergency number) IMMEDIATELY before using our app

  1. Professional Medical Care: Our Service does not replace professional medical care, emergency services, or trained medical personnel

  1. No Medical Diagnosis: We do not provide medical diagnosis, treatment recommendations, or prescription advice

  1. User Responsibility: You are solely responsible for your actions when following our guidance

  1. No Guarantee: While our protocols are based on recognized medical standards, we cannot guarantee outcomes in emergency situations

Voice Recognition and Processing:

- Voice data is processed through ElevenLabs voice technology on their servers

- We do not guarantee the accuracy of voice recognition or speech-to-text conversion

- Voice recognition accuracy may be affected by background noise, speech patterns, accents, or technical conditions

- Voice Recognition Disclaimer: ElevenLabs is responsible for voice processing accuracy. We disclaim any liability for voice recognition errors, misinterpretations, or technical failures in speech processing

- Users should speak clearly and verify that instructions are understood correctly before acting

THIRD-PARTY SERVICES

Our Service integrates with and relies on third-party providers:

ElevenLabs Voice Technology:

- Processes all voice interactions and speech recognition

- Voice data is transmitted to and temporarily stored on ElevenLabs servers

- Subject to ElevenLabs' terms of service and privacy policy

- We are not responsible for ElevenLabs service availability or voice processing accuracy

Analytics Services:

- PostHog: Tracks user interactions and app usage patterns

- Google Analytics: Monitors website and application performance

- Data is processed according to their respective privacy policies

Payment Processing:

- Paddle: Handles all payment transactions and billing

- Subject to Paddle's terms of service and privacy policy

Your use of these integrated services is subject to their respective terms of service and privacy policies.

INTELLECTUAL PROPERTY RIGHTS

The Service and its original content, features and functionality are and will remain the exclusive property of Aidhub Ltd and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

MEDICAL CONTENT AND PROTOCOLS

All first aid protocols and medical guidance provided through our Service are:

- Based on internationally recognized emergency medical standards

- Reviewed by qualified medical professionals

- Updated regularly to reflect current best practices

- Intended for use by non-medical personnel in emergency situations

You acknowledge that:

- Medical protocols may vary by region and institution

- Our guidance is based on general principles and may not apply to all specific situations

- You should seek additional training through certified first aid courses

PRIVACY POLICY

CONTENT

Our Service allows you to interact with voice recognition systems and receive emergency guidance. You are responsible for the accuracy of information you provide during emergency situations.

TERMINATION

Termination by Us:

We may terminate or suspend your account and bar access to Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever including without limitation if you breach the Terms.

Termination by You:

If you wish to terminate your account, you may contact us to request account deletion. Upon termination:

- Your access to the Service will be immediately revoked

- Your account information may be retained as described in our Privacy Policy

- Emergency session data may be retained indefinitely for safety improvement purposes

- One-time payments are non-refundable and access will be permanently lost

Data Retention After Termination:

Even after account termination, we may retain certain information as outlined in our Privacy Policy, including emergency usage data for medical protocol improvement and safety analysis.

DISCLAIMER

The information on this Service is provided on an "as is" basis. To the fullest extent permitted by law, this Company:

- Excludes all representations and warranties relating to this Service and its contents

- Does not warrant that this Service will be constantly available, or available at all

- Does not guarantee the accuracy, completeness, or usefulness of any emergency guidance

- Does not warrant the accuracy of voice recognition or speech processing provided by ElevenLabs

EMERGENCY SITUATIONS:

While we strive for accuracy in our emergency protocols, we cannot guarantee successful outcomes in emergency situations. Emergency medicine involves inherent risks and uncertainties that our Service cannot eliminate.

VOICE TECHNOLOGY DISCLAIMER:

Voice recognition and processing are provided by ElevenLabs. We disclaim all responsibility for voice recognition accuracy, speech-to-text errors, or any consequences arising from voice processing failures.

LIMITATION OF LIABILITY

In no event shall Aidhub Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

EMERGENCY SITUATIONS:

You acknowledge that emergency situations involve inherent risks. Our Service is designed to assist, but cannot guarantee outcomes. You use our emergency guidance at your own risk.

VOICE PROCESSING LIABILITY:

We specifically disclaim liability for any damages arising from voice recognition errors, speech processing failures, or misinterpretation of voice commands by ElevenLabs technology.

PAYMENT LIABILITY:

We are not liable for any issues with payment processing handled by Paddle, including but not limited to payment failures, billing disputes, or data security issues related to payment information.

GOVERNING LAW

These Terms shall be interpreted and governed by the laws of Bulgaria, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

CHANGES TO TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

BY USING SERVICE OR OTHER SERVICES PROVIDED BY US, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM.

EMERGENCY ACKNOWLEDGMENT: You specifically acknowledge that:

  1. You understand the limitations of our Service in emergency situations

  1. You will call emergency services (112) in life-threatening situations

  1. You use our emergency guidance at your own risk and responsibility

  1. You will not rely solely on our Service for emergency medical care

  1. You understand that voice recognition is provided by ElevenLabs and may not be 100% accurate

  1. You accept the session limitations of the free tier and understand that full access requires payment

PAYMENT ACKNOWLEDGMENT: You acknowledge that:

  1. All payments are final and non-refundable

  1. Free tier access is limited to 3 emergency sessions

  1. One-time payment provides permanent access to unlimited sessions

  1. Account termination results in loss of paid access without refund
